Looking for Mr John Appleton

Hello everyone,

I am new to this forum.

I have become a member as I am looking for some information on someone.

The person I am looking for is a Mr. John Appleton

I don't have much details on him, the only things I have are:

- Former solicitor from Wigan
- Must have retired 15/20+ years ago
- Worked as a solicitor for a firm in Wigan (I have no name)
- Must be in his 80's currently
- Last known to be living in Wigan

Any information would be brilliant!

Who are you - not a pseudonym
Why do you want to contact Mr Appleton - general
You don't know his age or his solicitors practice so I doubt you know him very well.
Please furnish me with more information and I may be able to help

Name - Steven Allen from Wigan

Why - Long story short, I am trying to purchase my first home with my girlfriend in Hindley and my solicitors (and the vendors solicitors) have hit a point of stalemate. It turns out, the lady trying to sell the house can't do so yet as it just so happens that a "Mr John Appleton" is a trustee on the property (this ladies parents used to live there), but the young lady didn't know about it, nor did the solicitors until about early October, and unfortunately, we need a signature from a "Mr John Appleton" who is a trust(ee) on the house and then the deal will be pretty much done - John is the key to unlocking the final piece of the puzzle, and both sets of solicitors are struggling to track him down at the minute, and it's been going on like this for 6/7 weeks now.

I personally don't know him, the above is my situation - the information I have provided above is from my/their solicitors.

I'm just a 28 year old lad trying to buy his first home with his partner after many months of searching the property market.

Section 36 of the trustees act lets the seller appoint a new trustee if the original cannot be traced,or is dead. There might be a timelimit, and itmight have to be publicly advertised.
Ask your lawyer why they haven't started this.
Have you exchanged contracts? There's a lot of gazundering going on at present !

Hmm - never heard of this before!

I'm currently in a back and to war with them at the minute, and while in this stalemate, I am trying to do my own investigating for this John Appleton as the seller's solicitors are being SO slow.

I'll contact him today and I'm sure he'll speak to you - if you give me the solicitors name and telephone number he can contact them direct and sort it quickly.

Hi JL54,

Really? That would be amazing! Literally amazing.

The solicitors that the seller is using are Woodward Solicitors, Wigan (0345 340 0061) I have don't have a contact there as they're not my solicitors, but the sellers (mine told me that John should contact them first)

JL54 - Could you ask him to confirm the property (just in case by some random miracle, there is another John Appleton who is a trustee on a property in Wigan) - I wouldn't want to cause any confusion!

If he would like to speak to me personally, I have no problem with that - it's completely up to him!

Just to confirm - John has contacted Woodwards this morning who have confirmed the situation, they are sending him the relevant paperwork to inspect and sign.
Should be all sorted soon for you.

I have emailed the solicitors to confirm that everything was correct and they had the right guy, just waiting for a response now.

Hopefully! This is the last piece of the puzzle, hopefully, it has been solved and JL54's friend, John, is the John they're looking for! As I mentioned above, it would be some random miracle of there was another John Appleton who is a trustee on a house in Wigan - it'd be crazy!

There was a firm called Wright & Appleton Solicitors in Wigan, was your man connected to that firm ?

If so, it is now Platt & Fishwick solicitors, at the same address, The Old Bank, 47 King Street, Wigan, Lancashire, WN1 1DB.

If it is the right firm, Platt & Fishwick, or if yoo are prone to spoonerism's like I am, Flatt & Pishwick, they will have taken over the affairs of Wright & Appleton solicitors

Or they might not have anything to do with your man at all.

Hmmmmmm., I see what you mean TTS, first it's in Hindley, then it's in Wigan, definately shadey that. It's not normal behaviour, that, buying a house and not being quite sure where it actually is!

Tonker: Hindley = in Wigan. The house I am purchasing is in Hindley, located in Wigan.

- The house is NOT mine, I AM purchasing it. The lady occupant is/was struggling to find a trustee her parents put on the house 15+ years ago, she didn't know there was one until her solicitors informed her after she placed it on the market.

Her solicitors were taking their time to find him, and I was running out of time with the deal on the house (and the seller was getting frustrated with how slow the going was getting), so I thought I would use the internet to try and find the person in question myself - to speed up the process for both parties (it worked, the solicitors & seller contacted me yesterday thanking me - as well as the estate agent, ALL Wigan firms)

Tommy: That is the truth, the whole truth, and nothing but the "trooth" JL54 has been an incredible help and without him, I wouldn't have the stress of weeks of searching for the person in question lifted off my shoulders.

I hope this makes sense.

Allens93 I don't know the facts!! but I do know what it's like trying to work with UK Solicitors - they don't think outside the box! have you tried searching probate records or the land registry - and if that fails you can show a UK court you tried everything (perhaps an advert in the paper may also be needed) you may then be able to get a trustee taken off the paperwork - and then the courts can give you permission to buy the property I believe. Try to run this by a solicitor or not just one more than one. Sorry Allens93 just read above!!

Well I know a few people who have bought a house in Hindley, and they didn't have any trouble with trustees
